Immediately after any sort of accident that we handle it is very common for the client to receive either direct physical contact or contact by telephone from an insurance adjuster requesting that the client give a recorded statement. A recorded statement is nothing more than the insurance companies attempt to gather information or testimony from the injured party that can then be used against a person at a later date. We strongly recommend that a recorded statement never be given. Insurance adjusters have a tendency to suggest that a recorded statement is standard operating procedure and that the injured party is under some sort of obligation to cooperate. Please recognize that if you were the injured party and not at fault for the accident, you are in control. The insurance adjuster is not in control no matter how aggressively they act toward you.

Our response generally is to respond with a denial of the request or with a suggestion that our client’s recorded statement can certainly be taken after we have had a chance to take a recorded statement of the “at fault” driver or party. We have made this suggestion to insurance adjusters on thousands of occasions and have never once had an insurance adjuster take us up on the offer. This simply is an admission by the insurance company that they do not want to deal with the injured party on an equal playing field.
